Copyright, it’s always a misunderstood area. My interpretation in connection with my work is this, I am a photographer, when I push the button on my camera I have created an image, that image belongs to me, I own the copyright and all rights connected to the use of that image both in it’s original form and any other modified form it may ever appear in.
Exceptions:
- Prints, when someone buys a print of a photograph from me they are buying the physical print, they are not buying any rights to it so they may not scan it, copy it, etc etc in any way, the same applies to my books and other media.
- Licensing, my images may appear in books, magazines, websites etc and when this is allowed a ‘usage licence’ has been granted (or ‘bought’) which allows the image to be reproduced a set number of times in a particular publication / website / location.
- Contract, hire me to take photos of you and I retain copyright but you are granted full and exclusive useage rights, this means I don’t show the photos around and you can use them for what you like where you like within the terms in the specific contract.
Copyright Infringement, if anyone uses any of my images in any way anywhere without my permission they have breached copyright. Wherever they are in the world they will be pursued for civil and, if applicable, criminal prosecution. I am very easy to find and contact so there is no excuse for not seeking permission. Remote-linking to one of my images to display it on your website or blog IS unauthorised use (just ask me if you want to use an image this way). Printing a copy of an image from my website IS unauthorised use (contact me if you would like to own a print). Just because a copy of an image is on your computer after viewing my website, such as in your cache, does not mean you have any rights nor permissions to do anything with it. My images on my web sites, blogs, etc. are still mine, just because I show them to you does not make them ‘public domain’.
You may see my images displayed with implied copyright to another entity such as my companies ‘TwistedPhotography’ and ‘Twisted Arts’ and some stock libraries & picture agents, these entities are representing me in managing my copyright and licensing permissions. Copyright remains mine.
The Nice Bit; Having said all that, I’m a nice guy, I make nice photographs and I want to share them with the world. Prints are available of most of my work, all limited edition, If you would like to discuss ownership of a print do please contact me directly. Also I’m not too much of a hard-ass about use of my images on web sites and blogs, as long as you do not alter my image, or imply it is your work or you in the photo and you make it clear who’s work it is (a link to my website is fine) then we’ll be friends.
